Marc McPeak
Marc has been practicing law for over 20 years. He received his Bachelors of Arts from American University and his law degree from Northwestern University School of Law.
Marc was named to the list of “Rising Stars” by Super Lawyers and published in Texas Monthly Magazine in 2009, 2010 and 2013.
Marc has also been General Counsel in the private sector giving him deep experience in start-up and established business. Key facets include healthcare laws (ie. HIPAA, OSHA, Employee issues), commercial real estate and franchise law.
Marc has also developed significant experience representing and counseling financial institutions in state and federal courts and before governmental and regulatory agencies and entities in connection with actual and threatened litigation and investigations related to residential mortgage loans including securitization. He has extensive experience in the contractual nuances with residential mortgage, loans, trust and preferred securities and bank subordinated debt securities.
He has experience with the enforcement of contractual and statutory non-compete and confidentially obligations through temporary and permanent injunctive relief to protect clients’ confidential and proprietary information.
Marc has expertise managing complex electronic discovery issues and matters including negotiating extensive document search and collection protocols including millions of documents and pages.
He gained national notoriety for his pro-bono representation of Kerry Max Cook in Smith County Texas that found Mr. Cook was wrongfully convicted and is innocent of a horrific murder for which he spent 20 years on Texas’ death row. Marc’s four decade quest for justice for Mr. Cook was featured in a New York Times story in March 31, 2012 entitled, “Released but Never Exonerated, a Man’s Fight for Freedom.”
Private Sector:
Marc has significant experience on the business side of the table. As General Counsel in the private sector, he obtained deep experience in start-up and established business. Key facets include healthcare laws (ie. HIPAA, OSHA, Employee issues), commercial real estate and franchise law. In his role as GC, he dealt with labor issues. Marc managed an human resources team that worked with a PEO, and managed an IT team to ensure internal and external software development, acquisition and compliance. Marc’s DSO, Dental Services Organization, experience lead him to become President and CEO of a successful franchise business outside of healthcare.
